EchoClass Terms of Service

Updated: September 30, 2026

Effective: September 30, 2026

This English text is provided for convenience. If it differs from the Chinese version, the Chinese version prevails.

1. Acceptance and scope

This agreement is between you and Beijing Xiaoyu Changxiang Technology Co., Ltd. (“we” or “us”) for downloading, installing, registering, signing in to, or using the EchoClass app and related services.

Please read this agreement carefully before you use the service, especially terms that are bold or shown in a notice and that significantly affect your rights. By tapping Agree, registering, signing in, or actually using the service, you confirm that you have read this agreement and agree to be bound by it, except where the law provides otherwise.

If you do not agree, do not register or use the service. Where personal-information processing, a paid subscription, or auto-renewal needs your separate consent, we will obtain that authorization separately.

2. The service

EchoClass is a tool for classroom learning and for organizing audio and video. Depending on what is actually available, we may offer:

  • live speech transcription, segmented display, and audio playback;
  • live or after-class translation, and high-accuracy simultaneous interpretation;
  • import and transcription of audio and video files;
  • AI class summaries, key-point extraction, and study aids;
  • time markers, transcript viewing, and export in several formats;
  • account sign-in, data sync, membership, and transcription-time management;
  • other features shown in the product.

The features, supported languages and file formats, file-size and duration limits, device requirements, and what is available follow what the app shows at the time. We may adjust the service for technical capacity, operations, or compliance, while protecting your lawful rights as required by law.

3. Accounts and sign-in

  1. You may register or sign in by the methods the app actually offers, such as a phone verification code, Apple, WeChat, or another supported method. A phone number that has not been registered may create an account automatically the first time it is verified.
  2. You should provide true, lawful and valid information, and keep your device, verification codes and third-party authorizations safe. Loss caused by your own disclosure, lending, or failure to keep them safe is your responsibility as provided by law. If you notice unusual use, contact us promptly.
  3. An account is in principle for the person who registered it. You may not give, rent, lend, sell, or otherwise transfer the account without our written consent.
  4. Some versions may offer a guest mode. Features, how data is kept, and whether it can be restored on another device may be limited. Follow the notices in the app. Uninstalling the app, clearing device data, or a damaged or replaced device may make local data that has not been synced impossible to recover.
  5. You may request account deletion by the path provided in the app. Before you delete it, deal with unfinished orders, remaining benefits, and data you need to keep. How deletion is handled follows the notice on the deletion page and the Privacy Policy.

4. Rules of use

You should use the service lawfully, honestly and reasonably. You may not use EchoClass to do, or help others do, any of the following:

  • upload, transcribe, translate, generate or spread content that is illegal, harmful, or infringes another person’s lawful rights;
  • record, upload, copy or spread another person’s class, meeting, conversation, audio, video or other protected content without authorization;
  • infringe another person’s privacy, personal-information rights, copyright, trade secrets, reputation, or other rights;
  • bypass technical limits, register accounts in bulk, maliciously consume resources, interfere with the service, or reverse-engineer, crack or attack the app;
  • use the service to cheat on an exam, commit academic misconduct, conduct unlawful surveillance, defraud, impersonate, or for any other improper purpose;
  • any other act prohibited by law.

If we have reasonable grounds to believe your conduct breaks the law, this agreement, or may harm the safety of the service, we may, depending on the nature of the conduct and as the law allows, remind you, limit features, pause the service, keep necessary records, or terminate the account, and we will provide a way to appeal or give feedback.

5. Audio, video and class content

Before you start recording, transcribing, or uploading a file, confirm that you have the necessary permission. Countries and regions differ on classroom recording, recording conversations, personal information and course copyright. You should follow the laws and rules that apply where the content is created, where it is used, and where the people involved are located.
  1. You warrant that you have a lawful right in the audio, video, course materials and text you upload or process, or that you have the necessary consent of the teacher, classmates, meeting participants, copyright owners and other relevant people.
  2. Except as needed to carry out transcription, translation, summary, sync, storage, export and similar functions that you request, we do not take ownership of your class content under this agreement.
  3. You may not use a transcript, translation or AI summary to infringe the rights of the course provider, or to publish, sell or sublicense it beyond the permission you received.
  4. You may use a share link to give others a read-only web page of a class’s transcript, translation and AI summary (not the recording). Anyone who has the link can view that content. You decide who receives it and how widely it is shared, and you are responsible for the consequences. Before you share, confirm that you will not infringe the copyright, portrait rights, privacy or personal-information rights of the course provider, the teacher, classmates or anyone else. You can revoke the link or set an expiry at any time. We cannot control further spread after someone forwards, copies or screenshots the link. Before a link is created, we automatically review the shared content. Content that violates the law (including harm to national security, obscenity, violence or terrorism, gambling or drugs, or fraud) cannot be shared. If you change the content after sharing, the original link stops working and a new one must be created, which is reviewed again. If shared content is illegal or infringes another person’s rights, we may stop access to that link as required by law.
  5. Export or back up important transcripts when you need to. How long they are kept, how to delete them, and what is synced to the cloud follow the Privacy Policy and the product pages.

6. Transcription, translation and AI

EchoClass uses automatic speech recognition, machine translation and generative AI to process content you submit. Output may omit content, misrecognize speech, mistranslate, lag, be incomplete, or contain factual errors, because of audio quality, network, accent, noise, several people speaking, context, technical terms and model limits.

AI output is only a study aid and should not be your only basis. For exam answers, academic citation, medical, legal or financial matters, safety decisions, or anything else important, check the original material and consult a qualified professional. Before you cite, submit or share the output, review its accuracy, completeness and suitability yourself.

A translation shown during a live session may be provisional and may change when speech recognition is corrected or the class is organized afterward. Some content may produce only a partial translation if you turn translation on partway through, the network drops, time runs out, or because of a feature setting.

To the extent the law allows, we will keep improving quality, but we do not promise that any transcription, translation or AI output is absolutely accurate, continuous, real-time, or fit for your particular purpose.

7. Membership, credits and paid services

7.1 Charges

Some features require a paid membership or a purchase of credits (a top-up pack). EchoClass measures usage in credits. Live transcription and file transcription deduct credits by actual processing time. AI summaries, paragraph translation and similar features deduct credits per use. The price of each feature is on the Credit Rules page in the app. The price, membership period, how many credits are issued and how often, the scope of benefits, validity, limits and payment method are those clearly shown and confirmed by you when you place the order.

7.2 Issuing and charging credits

Membership benefits are issued as credits by period, not as the whole term’s allowance at once. A weekly plan is issued every 7 days. Other plans are issued once each calendar month. The amount issued each period is as shown on the purchase page. Credits for a period are valid only during that period. Unused credits expire automatically when the period ends and do not carry over. When a subscription expires or ends, unused credits for the current period expire at the same time. Please plan your use within the validity period.

A top-up pack is a one-time credit. Its validity and what it covers follow the purchase page. Unused credits expire when it ends.

Live transcription and file transcription deduct credits by actual processing time. AI summaries, paragraph translation and similar features are deducted per use. Members and non-members are charged on the same basis. Non-members may have a limited number of free trials, as shown in the app. Failed tasks, abnormal interruptions, rounding, and refunds of credits follow what is published on the purchase page or the relevant feature page. We will not limit your benefits through a usage cap that was not disclosed in advance. We may take necessary measures, as the law allows, against abuse such as bulk machine calls or resale of accounts.

The number of credits issued and the consumption rules (the price of each feature) are set by us and published in the app. We may adjust credit consumption rules when operating costs, service costs, or laws and regulations change. An adjustment will be published in the app in advance, or notified in another prominent way, and applies to consumption after the stated effective time. Consumption that has already occurred, and benefits already promised in an existing effective order, are not affected retroactively.

If the number of credits issued is wrong, we will correct it as required by law. If too few were issued, we will make up the difference promptly. If too many were issued, we may take back the excess (by deducting unused credits, or by offsetting credits you receive later) and will tell you about the correction. If the credits you actually receive do not match the order or the page, contact us at the support email and we will handle it after verification.

7.3 Subscription, renewal and cancellation

An iOS membership plan is an auto-renewing subscription bought through the Apple App Store. After you confirm the subscription and authorize Apple to charge you, it renews automatically for the period you chose until you cancel. The subscription name, the current and later prices, the period and the benefits follow the purchase page and Apple’s subscription confirmation. A top-up pack is a one-time credit purchase. It is not bought automatically with the membership subscription.

You can manage later renewals on iPhone or iPad under Settings → your Apple Account → Subscriptions → EchoClass → Cancel Subscription. Cancel before the next renewal, and rely on the renewal date and cancellation result shown by Apple. Uninstalling the app, signing out, or deleting your EchoClass account does not cancel the Apple subscription. After you cancel, you can usually keep using the service until the end of the period you have paid for. We will prominently explain these points before you subscribe and before an auto-renewal, as required by law, and we will provide a simple way to cancel.

An ordinary membership plan paid on Android with WeChat or Alipay is a one-time purchase. If we later offer an auto-renewing product, we will explain it prominently and obtain express authorization before purchase. Subscription rules are in the Membership Service Agreement.

7.4 Refunds and price changes

Membership plans and top-up packs are digital service benefits. Except where the law, applicable platform rules, or an express promise by us requires a refund, once benefits are activated or credited we do not offer no-reason refunds because you no longer wish to use them or did not use them often, and we do not cash out remaining benefits. This does not exclude statutory remedies for a duplicate charge, benefits that were not delivered, or a service that does not match what was agreed, and it does not limit a statutory right to return goods without reason or to terminate the contract where that right applies.

A refund request for an Apple transaction is reviewed by Apple under its rules and applicable law. We provide necessary help. Other channels can ask us to check the order by the support email. After a refund succeeds, the benefits of that order are withdrawn to the extent of the refund. Other valid orders are not affected. Price and plan changes apply only to later transactions. They do not retroactively reduce benefits of an order that has already taken effect.

8. Personal information and data

We take your personal information and content security seriously. Why and how we process your phone number, third-party account identifiers, device information, audio and video, transcripts, translations, AI summaries, markers, orders and usage records, and for how long, and what rights you have, are set out in the EchoClass Privacy Policy.

To provide SMS verification, object storage, speech recognition, translation, AI summaries, payment and similar features, we may lawfully engage or connect third-party services. We will take the contractual, permission and security measures required by applicable law, and describe them in the Privacy Policy or a related list.

When you upload content that includes another person’s voice, name, identity, views or other personal information, you should make sure you have a lawful basis to process it, and you should avoid uploading sensitive information that is unrelated to study.

9. Intellectual property

  1. Intellectual property in the EchoClass app, interface design, software, trademarks, icons, written descriptions and related content belongs to us or the relevant rights holders.
  2. You keep the rights you lawfully have in content you upload and in results lawfully produced from it. To provide the features you choose, you grant us a limited license, restricted in time and purpose to what the service needs, to store, copy, convert, recognize, translate, generate a summary, and show or export the result to you.
  3. That license does not mean we may publish your class content, sell it, or use it for a purpose unrelated to providing the service to you. If we use it to train a model or for anything else beyond what is necessary, we will give a separate notice and obtain the corresponding authorization as the law requires.
  4. If you believe content on the platform infringes your lawful rights, send proof of ownership, the location of the material and your specific request to the contact in this agreement. We will handle it as required by law.

10. Third-party services

EchoClass may include sign-in, payment, SMS, cloud storage, speech recognition or AI capabilities provided by third parties. When you use a service provided directly by a third party, you should also follow the terms and rules that third party lawfully shows you. A third party is responsible as required by law for the service it provides on its own. We will manage and safeguard vendors that we choose and engage, as required by law.

11. Changes, interruption and termination

We may pause or adjust part of the service for maintenance and upgrades, network or cloud failures, device compatibility, regulatory requirements or security risks, and we will notify you in advance or promptly when that is feasible. These events are not automatically force majeure. Force majeure is judged under section 12. For a paid service that has not yet been performed, we will continue performance, offer an alternative, extend the period, refund accordingly, or take a similar step, under the law and the order.

You may stop using the service at any time. If you seriously break the law or this agreement, we may restrict or terminate the service as the law allows. Except for urgent safety action, we will explain the reason when we can, and provide a suitable way to appeal.

12. Limits of liability

  1. We will take technical and management measures suited to the service, as required by law, and will work to keep the service safe, stable and available.
  2. Responsibility arising from your unlawful use, recording or uploading without authorization, acting on AI output without checking it, or infringing a third party’s rights is borne by the responsible party as required by law.
  3. Events such as earthquakes, typhoons and floods excuse a breach only when they meet the legal conditions of being unforeseeable, unavoidable and insurmountable, and they actually make the contract impossible to perform. We are excused in part or in whole according to the actual effect and the causal link, unless the law provides otherwise. We will notify you promptly, provide proof within a reasonable time, and take reasonable measures to reduce loss and restore the service. Force majeure that occurs after a delay in performance does not excuse the delay. Loss that grows because reasonable measures were not taken is borne as required by law.
  4. An ordinary network failure, server maintenance, or a vendor outage is not automatically force majeure. Being excused by law does not automatically mean we keep the full fee for a service that was not performed. If the purpose of the contract cannot be achieved, or the law requires termination or a refund of the fee for the unperformed part, we will still handle it as the law requires. A temporary interruption is handled by restoring performance, agreeing a delay, or similar steps, depending on the effect.
  5. No limit of liability applies to personal injury or property loss caused by intent or gross negligence, and none excludes or limits a consumer right that the law says cannot be excluded or limited.

13. Minors

If you are under 18, read and use the service under a guardian’s guidance. Before a user under 14 uses a feature that processes personal information, a guardian should read the relevant rules and give consent as required by law. Guardians should guide minors to use recording, translation and AI reasonably, and to avoid over-reliance, excessive use, or uploading other people’s private information.

If a guardian has a question about a minor’s account or the processing of personal information, contact us using the details in this agreement.

14. Notices and contact

To the extent the law allows, we may send notices about the service by in-app messages, pop-ups, SMS, system notifications, notices from the purchase platform, or another contact method you provide. Matters such as auto-renewal and material changes to your rights will be highlighted as required by law.

15. Governing law and disputes

The formation, performance, interpretation and dispute resolution of this agreement are governed by the laws of the mainland of the People’s Republic of China.

If a dispute arises from this agreement or the service, the parties may try to settle it. If they cannot, they agree to bring a lawsuit in the People’s Court of Chaoyang District, Beijing, provided that court has the actual connection required by law and the choice does not violate rules on court level, exclusive jurisdiction, or other mandatory provisions. If this choice does not take effect or does not apply because there is no actual connection, because another court has exclusive jurisdiction, or for another reason provided by law, the dispute will be handled by a people’s court that has jurisdiction. Negotiation is not a precondition to suing as the law allows.

16. Other

  1. Headings are for convenience only and do not affect the meaning of the terms.
  2. If part of this agreement is held invalid or unenforceable, the rest remains effective.
  3. We may update this agreement as the service or the law changes. If a change materially affects your rights, we will give prominent notice before it takes effect and obtain consent again as required by law. This does not apply to a wording correction, an update of contact details, or an adjustment that does not affect your rights.
  4. If this agreement and a purchase page or a special rule differ on a particular service, the specific terms you confirmed when you used or bought that service prevail, provided they do not reduce your statutory rights.
